1. About These Terms

These Terms and Conditions govern the provision of driving tuition services by RED Driver Training (ABN 59 891 070 820), located on the Gold Coast, Queensland, Australia (“we”, “us”, or “our”). By booking a lesson with us, you (“the student” or “the client”) agree to be bound by these terms. If you are under 18 years of age, a parent or guardian must also agree on your behalf.

2. Bookings

• All bookings are subject to instructor availability and are not confirmed until you receive written or verbal confirmation from us.
• To secure a booking, you may be required to pay in advance or provide valid contact details.
• Bookings are personal to the student named at the time of booking and are not transferable to another person.
• You must hold a valid Queensland learner licence (or equivalent) before your first lesson. It is your responsibility to ensure your licence is current and in your possession at every lesson.

3. Cancellation & Rescheduling Policy

We understand that life happens. However, our instructors' time is reserved exclusively for you, so we ask that you give us as much notice as possible if you need to cancel or reschedule.

• More than 24 hours' notice: You may cancel or reschedule at no charge. Any prepaid amount will be credited to a future lesson or refunded on request.
• Less than 24 hours' notice: The full lesson fee is payable. No credit or refund will be issued for late cancellations.
• No-show / non-attendance: If you do not attend your lesson and have not contacted us beforehand, the full lesson fee is forfeited.
• Extenuating circumstances: We will consider genuine emergencies (e.g., sudden illness, hospitalisation) on a case-by-case basis. Please contact us as soon as possible with supporting information.

To cancel or reschedule, please contact us by phone or text on 0447 323 562 or by email. The date and time of your message will determine which policy applies.

4. Instructor Cancellations

In the rare event that we need to cancel a lesson (e.g., instructor illness, vehicle breakdown, or severe weather), we will notify you as soon as possible and offer you the next available time slot at no additional cost. We are not liable for any costs or losses you incur as a result of an instructor-initiated cancellation.

5. Refund Policy

• Refunds for prepaid lessons or lesson packages are only issued where no alternative solution (e.g., rescheduling or credit) can be agreed upon.
• Refunds will not be issued for lessons that have been completed.
• Refunds will not be issued for late cancellations (less than 24 hours' notice) or no-shows.
• Where a refund is approved, it will be processed within 7 business days using the original payment method.
• If a refund is requested for an unused portion of a package, any lessons already taken will be charged at the standard single-lesson rate, as the package discount is voided. The refund amount will be the original amount paid, minus the full single-lesson rate for each lesson completed.
• If you fail your driving test, no refund or discount on future lessons will be provided, although we will continue to support you in preparing to re-sit the test.

6. Lesson Conduct

• Students must arrive on time for pick-up. Waiting time beyond 10 minutes may result in the lesson being treated as a no-show at the instructor's discretion.
• Students must not be under the influence of alcohol, drugs, or any medication that impairs driving ability. The instructor reserves the right to refuse or terminate a lesson if this is suspected, and the full lesson fee will apply.
• Abusive, aggressive, or unsafe behaviour towards the instructor will result in immediate termination of the lesson. No refund will be issued.
• The instructor may terminate a lesson at any time if they believe continuing poses a risk to safety. The full fee will apply.
• Mobile phones must not be used by the student while driving, in accordance with Queensland road rules.

7. Vehicle & Safety

• All tuition vehicles are maintained to a roadworthy standard, hold current Queensland registration, and are fitted with dual controls.
• Students and all occupants must wear a seatbelt at all times during lessons.
• Any damage to the vehicle caused by the student through deliberate or reckless behaviour may be charged to the student or their parent/guardian.
• RED Driver Training carries appropriate public liability and vehicle insurance. However, we recommend that students and their families review their own insurance arrangements.

8. Lesson Packages

• Lesson packages must be used within 12 months of the purchase date unless otherwise agreed in writing.
• Packages are non-transferable and may only be used by the student named at the time of purchase.
• If a refund is requested for an unused portion of a package, any lessons already taken will be charged at the standard single-lesson rate, as the package discount is voided. The refund amount will be the original amount paid, minus the full single-lesson rate for each lesson completed.

9. Pricing

All prices are listed in Australian dollars (AUD) and are inclusive of GST where applicable. Prices are subject to change without notice. The price at the time of booking confirmation will apply to that booking. Additional fees (e.g., out-of-hours surcharge for night lessons) will be disclosed before booking.

10. Privacy

We collect personal information (name, contact details, and licence information) solely for the purpose of providing driving tuition services. We will not share your information with third parties without your consent, except where required by law. By booking with us, you consent to us holding and using your information for these purposes.

11. Limitation of Liability

To the extent permitted by law, RED Driver Training's liability for any claim arising out of the provision of driving tuition services is limited to the cost of the lesson(s) in dispute. We are not liable for any indirect, consequential, or special loss or damage. Nothing in these terms excludes any rights you may have under the Australian Consumer Law.

12. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.

13. Changes to These Terms

We may update these terms from time to time. The current version will always be available on our website. Continued use of our services after any changes constitutes acceptance of the updated terms.
